These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Bluejersey18 Technologies Private Limited ("Sportomic", "we", "us", "our"). By accessing, using, or participating in any of the services provided by the Sportomic Platform, you agree to be bound by these Terms and any other policies posted on the platform. If you do not agree with these Terms, you must immediately stop using the platform.
By using the Sportomic Platform, including the TRAIN, BOOK, and EVENTS modules, you agree to abide by the following Terms. If you are accessing or using Sportomic on behalf of an entity, you represent and warrant that you have the authority to bind that entity.
We reserve the right to modify, amend, or update these Terms at any time, and such modifications will be effective immediately upon posting on the Sportomic Platform. It is your responsibility to review these Terms periodically. Continued use of the platform constitutes your acceptance of any changes.
Platform: The Sportomic website, mobile app, and any related services.
Services: Services provided by Sportomic, including access to sports venue booking, event management, and SaaS tools for venue operators.
User Content: Content uploaded by users, including ratings, reviews, photos, and feedback.
Venue Operator: A sports facility or venue using Sportomic’s SaaS for daily operations.
To access certain services, you must create an account with Sportomic. By registering, you confirm that you:
Are at least 18 years old (or have parental consent if under 18).
Provide accurate and complete information.
Agree to maintain the confidentiality of your account credentials.
You are solely responsible for all activities that occur under your account.
Sportomic provides a platform for booking sports venues, participating in events, and offering SaaS tools for venue operators. You agree not to:
Use the platform for illegal or unauthorized purposes.
Upload or share content that violates applicable laws or infringes the rights of third parties.
Engage in any activity that disrupts the operation of the platform or harms other users.
Sportomic is not liable for any issues arising from the actual performance of venue operators or sports activities. All venues listed on the platform are responsible for their services.
Facility quality and safety.
Staff and equipment availability.
Compliance with local regulations.
Sportomic acts only as an intermediary and does not guarantee the performance or satisfaction with any venue operator or event organizer.
The Sportomic Platform may integrate with third-party services such as equipment rentals, insurance providers, and other service providers. Sportomic:
Does not endorse, guarantee, or assume responsibility for the quality or performance of these third-party services.
Is not liable for any issues arising from the use of third-party services.
Users are encouraged to review third-party terms and policies before engaging with their services.
You retain ownership of your User Content but grant Sportomic a worldwide, royalty-free, non-exclusive license to use, modify, distribute, and display such content across the platform for marketing, promotional, and operational purposes. You represent and warrant that:
Your content does not infringe on any third-party rights, including intellectual property.
Your content is accurate, lawful, and not misleading.
Venue operators using Sportomic's SaaS tools agree to the above.
Use the platform exclusively for managing their venue operations, including bookings, scheduling, and customer management.
Ensure that all venue information, including availability, pricing, and amenities, is accurate and up-to-date.
Comply with all local laws and regulations related to the operation of their venue.
Sportomic is not responsible for any claims arising from the use of the SaaS tools, including booking errors, customer disputes, or service failures.
Users participating in events through Sportomic acknowledge the inherent risks of sports activities. Sportomic:
Does not assume any liability for injuries, accidents, or property damage occurring during events or sports activities.
Encourages users to confirm their understanding and acceptance of the risks associated with participating in events by reviewing event-specific terms and waivers.
In the event of a dispute:
Users must first attempt to resolve the issue directly with the venue operator or event organizer.
If unresolved, the dispute may be escalated to Sportomic’s support team.
All disputes will be governed by Indian law, and any litigation will take place in Bangalore, Karnataka.
Sportomic provides a platform for user interactions and transactions but is not a direct party in these agreements unless explicitly stated.
Sportomic is committed to protecting your privacy. By using the platform, you agree to the collection, use, and sharing of your data as outlined in our Privacy Policy.
Data Retention: Sportomic retains your personal data for as long as necessary for the fulfillment of services, compliance with legal obligations, and business purposes. User data will be deleted in accordance with applicable data protection laws and Sportomic's Privacy Policy.
To the maximum extent permitted by law, Sportomic shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. This includes, but is not limited to, loss of profits, loss of data, or injury to persons or property resulting from venue bookings, event participation, or third-party integrations.
You agree to indemnify and hold harmless Sportomic and its affiliates from any claims, losses, or damages, including legal fees, arising from:
Your use of the platform.
Breaches of these Terms.
Your interactions with venue operators, event organizers, or third-party service providers.
Sportomic reserves the right to suspend or terminate your account under the following conditions:
For violations of these Terms.
For engaging in fraudulent or harmful activities.
If your actions pose a risk to the platform, users, or venue operators.
Sportomic will not be liable for failure or delay in performance under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, strikes, or technical failures.
These Terms are governed by the laws of India. Any legal action related to these Terms will be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
